SEC violated procurement law by purchasing Apple equipment

The Washington Post reports that the SEC violated procurement law when it purchased almost US$1 million in computer equipment from Apple in 2008. In a report released last week, the SEC's inspector general said that after the purchase the computer equipment "immediately failed" to work as intended. The report says that the SEC violated federal regulations when it told Apple its budget for one of the orders and failed to seek out any further competitive bids.

The SEC was seeking to purchase updated equipment in order to help meet its expanded duties in regulating the financial industry. Prior to the purchase, the SEC was still relying on old tape reels to store and back up data. The report also accuses Apple of wrongdoing. It says Apple used the known budget the SEC had (originally $200,000) and tailored the order around that. However, Apple left out "essential equipment that the SEC was subsequently forced to purchase," according to the report. That essential equipment cost the SEC another $773,000. The SEC said that "appropriate action was taken" against the employee responsible for the purchase. Apple spokeswoman Kristin Huguet declined to issue a comment on the matter to The Washington Post.

WatchESPN arrives for iPad sports viewing

ESPN finished the week by rolling out its promised iPad version of WatchESPN (free, App Store). The new version gives live access to all ESPN channels but with a much wider canvas both to see the games and TV segments themselves as well as a much more visual browser for live content. ESPN didn't mention an upgrade to the video quality, though it's expected to take better advantage of the larger screen....

Sony rumored cutting NGP specs to compete with 3DS, iPod

Sony might be stripping down the performance of the NGP to better take on the Nintendo 3DS and Apple's iPod touch. A rumor late Thursday from France's 01net claimed that developers had been told the NGP would have half the main RAM, 256MB, and a similar cut to 128MB of video RAM. It may also drop the 16GB of built-in storage and shed the plain SD card slot in favor of a possibly more proprietary format with copy protection; whether that was Memory Stick or another format wasn't mentioned....

Patent suit du jour involves videophone features, hits Apple and AT&T

For non-practicing entities -- companies that make a living purely out of holding patents and then licensing them to and/or suing companies that actually make things -- business is good (as usual). The latest NPE strike, reported by FOSS Patents, means that Apple, AT&T and US Cellular are getting hit with lawsuits saying the companies are infringing videophone patents.

The suit, filed by Visual Interactive Phone Concepts Inc. in a Michigan District Court, says the use of a "videophone interactive mailbox facility system and method of processing information" violates two patents.

The patents in question aren't very detailed, and seem to be more a vague method than an invention. The allegations claim that the 2 cellular companies and Apple services "act as a mailbox facility system." Well, OK then. Since the claim is so generic, it's likely other mobile phone OS and hardware vendors that include video calling functionality in their products will be sued as well.

VIPS Inc. previously reached settlements with the targets of patent suits in 1999 and 2007. We'll see how Apple and AT&T choose to respond, and whether they think the cost of litigation will outweigh the cost of simply biting the bullet and licensing these patents.
